Might they be compensating for mounting pressures and stresses from the mounting points (at the edges of the assembly) on the shape of the heat sink? Could be...

Haha cheers dude, i'm not afraid it'll explode on me when i hook up more than 2 fans now as well 
I've got 3 uv cathodes running, 4 case fans (1 front, 1 top, 2 rear exhaust), OC'ed E4500, 2 HDDs, 1 DVD Burner, and a HD3850 running on it now.
I'm planning to go crossfire at some point in the future if i save up enough cash to buy another 3850 since they're cheap now or possibly a 3870 and XFire them both, the 3850 has enough power to drive all my games at nice settings at 1280x1024 anyway which is all i have space for on my desk lol.
Another 3850 would let me run full AA and AF as well at good framerates

dirt cheap. $100 for the card another $100 for the battery backup (required for hardware raid cards to use the external cache. Keep an eye on ebay if you want one. They work great with nvidia chipsets, but require modding with intel chips. Although the mods are supposedly pretty easy.

No, I didn't send it back yet. I googled the net and looked at reviews and discussions and itloks that I'm not the only one (look at this review, the base looks similar to what I have). I have even read that it may be not flat by design to match the imperfect IHS (or to compensate the mounting pressure as you said).
So I tried to reinstall the cooler and now I have these temperatures (room temp was 25°C, CPU fan speed 1400 rpm, TjMax = 95, load temps are after 30 minutes of Prime95 In-place large FFTs):
I'd say that these temps are not bad, what do you think?

that load temp is just perfect RoyBatty.
i think i can assume from that there is nothing wrong with your cooler, the Noctua's cooler that you're using, is another good CPU cooler i believe. try using a few diferent thermal compound when you have a chance, try OCZ freeze i just heard it's quite good.

Well i managed to clock 2.96GHz on my E4500 so far all seems stable 
Trying to push it to 3GHz but i can't seem to adjust the Vcore options in my BIOS, i think i need to disable speedstep or something

I have found some people with the same CPU+cooler reporting similar temperatures, so I think it's OK. I have a tube of AC MX-2 I could try, but according to reviews its performace doesn't differ much (if at all) from the Noctua NH-T1.
Anyway, here is a picture of my rig with the Noctua installed:
And a detail of the HD4850 with VF900-Cu. The cooler is very close to the other card (TV tuner), but unfortunately it's not possible to install the cards any other way.

before i installed the board in a case i used to try MX-2 and then i change to use MX-1, i think the CPU cooler i use works better with MX-1, for whatever reason, i'm not sure.
i just think the CPU cooler that you use is supposed to be better for using with quad CPU than the one i'm using now.
here's (below) a test, room around 25C, the CPU was overclock a bit and using little bit more core voltage than yours.
and later i plan to change my CPU cooler, and also plan to try the OCZ freeze as well so i can compare them myself.
anyway, as i already told you that your temps result was looking well, i only thought it could be improved even more.
probably you don't need to care if you don't plan to overclock your CPU.
