Infinium Labs Vs. HardOCP
HARDOCP did an article on the "Phantom" console system back in September. You can read that Here Well it seems that Infinium Labs is upset about this article and want it removed in 10 days.
This is the official response from HardOCP: "I have extended HardOCP.com's pledge to correct any and all possible inconsistencies or errors in our editorial entitled “Behind the Phantom Console” personally to Timothy Roberts and Kevin Bachus of Infinium Labs and they have yet to inform HardOCP.com of any information we presented as being not correct. This courtesy was extended on September 17, 2003, the date the article was published and has been extended several times since then with no reply ever being received by HardOCP.com. It is my opinion that Infinium Labs' only interest is stifling HardOCP.com and our opinions. HardOCP.com still stands by our thoughts and opinions put forth in our editorial and no amount of legal badgering and frivolous lawsuits will change those opinions that we have shared with our readers." There's no base for a case, the article consists of well-written and well-researched investigative journalism. After reading the attornies letters, I think that the response comes from Roberts feeling backed in the corner after a potential financial backer found the truth.
Keep up the good work, Kyle. Someone has to make sense.

Infinium Labs Vs. HardOCP Legal Battle
Some drama going on over at Hardocp today, not sure if any of you will remember the "phantom" console report a while ago, here is a refresher.
"According to Game Daily, Infinium Labs held a press conference today saying they are upset with us over our article “Behind the Phantom Console” we published in September 2003. These are the letters we received from two sets of Infinium Labs legal counsel (MoFo & IcardMerrill) telling us we have 10 days to remove the article." Kyle has replied with: "I have extended HardOCP.com's pledge to correct any and all possible inconsistencies or errors in our editorial entitled “Behind the Phantom Console” personally to Timothy Roberts and Kevin Bachus of Infinium Labs and they have yet to inform HardOCP.com of any information we presented as being not correct. This courtesy was extended on September 17, 2003, the date the article was published and has been extended several times since then with no reply ever being received by HardOCP.com. It is my opinion that Infinium Labs' only interest is stifling HardOCP.com and our opinions. HardOCP.com still stands by our thoughts and opinions put forth in our editorial and no amount of legal badgering and frivolous lawsuits will change those opinions that we have shared with our readers. _____________________________ Kyle Bennett Editor-in-Chief @ HardOCP.com" |

I read, with great interest, the article and have to say that it was very well written with plenty of supporting research and documentation.
If Infinium Labs were to pursue a lawsuit, I'd expect they'd be shooting themselves in the foot.

My rather quick and dirty email to infinium labs
Hey lay off HardOCP, just because they are reporting information which may be inconvenient or uncomfortable quit the bullying strongarm tactics. All they're doing is reporting what they uncovered as the truth, if it's false I recomend you let em now whats false or put up the truth on your website. As it stands now you're just a bunch of swindling crooks resorting to the legbreakers to get your way. Pathetic. Andrew Rady EDIT: After thinking about it I think everyone should fire off an email to infinium and let them know what we think of this kind of strong-arm tactics, and their vaporware products. Lets show em that the enthusiast community is a force to be reckoned with.

I would not even recommend you even waste your time typing an email to them. We all know that they are never going to mass produce this product. I know I won't be buying one.

Upon re-reading the article, there are no points which are without concrete proof or supported evidence. Sorry IL, the damn is breaking, no one's gonna stick their head to clog it up. ![]() PS: I love quoting.
