NDA breaking and what will happen

as you are aware some sites broke the NDA by posting reviews of ATI next gen card.

please dont post any links or names to the sites or zardon will close this thread.

But I am wondering what exactly does it say in the agreement?

Does it say your not allowed to post the review of the card before 4th May 3PM GMT or does it say 4th may 3pm in the time zone your in?

cause no american site has posted a review yet just european sites...

and what will happen to the sites.


people who have the agreement please awnser becuase I am so curious in what will happen to those sites and how much trouble they are in?

It depends how seriously the company take the particular instance. Every site is given hardware with a strict time and date for example 6pm GMT 28th August - at this time the review/article can be posted publically. The site owner generally signs this agreement, meaning if its breached further action can be taken by the company supplying the hardware/product.

NDAS are also signed for other reasons, but these fall outside your particular question.

I'm cusious to know how much they can sue you for if you do drastically break an NDA for someone like ATi.... is there a possible jail sentence too? or does that depend on the country?

I'm sure there is a "huge" fine and possable jail time involved. laws verys from country but they agree to be governed by the laws of canada in thier NDA (regarding to the nda), as well as there are international laws that might be involved too, as well as I'm shure if they wanted they could chose the laws under that contries jeristiction if they are harsher. But lets just say thier gonna be knee deep in it....

I'd doubt that jail would be a risk, it's a civil matter of contract, after all - actually, are NDA's (or in this case, an embargo if it's "not for release UNTIL") enforcible in law?

At best, the guys concerned would never be allowed such privileged access again, but at worst .... I think they'd have to be sued?

i think signign an NDA shood give the issuer permission to sodomize you with a lead pipe if you break your end of the bargain....lol...that would be more binding then any law...cuz no1 enjoys that
