I didn't think they were contending it was in there, just that is wasn't part of the game. They knew it was in there, but if it was not intended to be in the game, I can't see how they could be held liable.

I still can't believe how big of a deal this turned into, its almost laughable. The sad thing is, this is going to negatively impact the gaming industry. I would not be surprised if federal legislation was passed telling programmers what they can put into their games (thanks Hillary "Stupid Bitch" Clinton). I think it hit close to home with her, after all, her husband won't even sleep with her.

I was informed that the ESRB's policy is that they are given all game content and media included with the game, whether in or out for review. This may be the specific reason why. Problem is, are they an advisory board with no judicial privledges? Can rockstar say "you can't see this part of the game" simply because they flipped a bit and excluded it from the final game?

Game glitches happen all the time and some allow people to see what they shouldn't. Think the zelda bug where you could save as you were switching screens and hop to parts of the map you weren't supposed to go. What if nintendo had hid zelda's bordello one screen past a cliff wall? This is just the first instance that is potentially damaging. You have parents deeming their children mature enough to play gta, and then having easy access to nudity that wasn't expected.

A guy at works thinks it was all a publicity stunt because rockstar thrives off controversy. They knew someone would find the content if they left it in.

I think we need to revise how the ESA rates games and back them with judicial power when cases like this pop up. This is also a loophole in the DCMA that should be addressed. Flipping a bit is not enough to hide media content, but can you shed all responsibility once someone flips that bit? It may not matter typically but the nature of the material in this instance will make a big public stink.

I agree with the guy you work with, that was my first notion when I saw this. Rockstar wouldnt even exist if it wasnt for stuff like this. Its funny, by making a stink about it, the "questionable material" has only been brought to attention and reached a much greater audience. When will people learn that sometimes the best action is no action at all.

The question is not really who is at fault for the content being there, but what form of litigation should take place because it IS there.

What will happen to the games industry now?

Hell, if you ask me nothing should happen to the games industry. Why? Because, if in theory, the code was part of the game, and it was merely unlocked by a modification to a few lines of code. Should not the ESRB have come across this? Should they not analyze every single thing within a game? Hell, how do they come up with their ratings anyways?

Does someone sit on a couch and play a game from beginning to end and try to find every little thing there is?

Like any government agency I'm sure the ESRB cuts corners where it can, etc. etc. and things were missed.

However, the fault really lies with parents. Could you, as a good parent, knowingly allow your child (most likely of a young age for console players) to play this game? I wouldn't. The problem is two things: 1) Parents that don't pay attention to, or care what, their children are playing/buying/doing. and 2) Retailers that do not take the necessary steps to insure these games do not fall into the hands of children.

Why are retailers not as intent on carding people for videogames as they are for alcohol? Because of crappy legislation that makes the ESRB rating a SUGGESTION not a legal REQUIREMENT. Oooo retailers (and I am in retail management) have a policy in place that if a clerk sells a MA or AO rated game to a minor they are fired, etc. etc. Well to be honest, if that MA or AO game sells 500000 copies at that retailer...are they going to really have themselves ina tissy? Think of all that profit, what business man/woman in their right mind would push that away when there is no repurcussions for selling them to minors?

Rockstar Games had built that mini-game in San Andreas. And the creator of the mod just unlocked it. ESRB probably had no idea that the mini-game was in their. But Rockstar just denied it, just like any other company.

I dont see what the big deal is, I mean its ok to go around "killing" hundreds of people including innocent bystanders with a variety of weapons and vehicles, yet when something sexual appears everyone freaks out. The game is already rated 18 in the UK.

It was the same with Manhunt, with censorship boards all getting their panties in a wad saying Rockstar were evil and creating copycat killers. Such a load of bollocks, Manhunt was great fun but if people cant decide were to draw the line or feel a game makes them go out and kill people then they are just blaming other issues on their mental ill-being.

I think a major issue is that parents are letting their young kids play these games. The idea of a video game to a lot of people are that they are only for children, not a viable form of adult entertainment. This is of course as wrong as it could be.
It's been said 1 million times, but "parents need to start taking an active roll in what their children are doing". It seems to me all this fuss could have ben avoided if mom and dad just bothered to peek in on what little Jimmy was up to in his bedroom.
