This guy is an idiot. He doesn't have a leg to stand on and yet he still thinks that he can take evenbalance (makers of punkbuster) to court and win. His reason is because someone was using his cd key and they were both online at the same time and got banned. He thinks that since he never gave out the key and was never cheating it it the responsibility of EB to prove to him he was a. cheating or b. show who was using his key.

I think that the punkbuster EULA sucks though especially this part:

I do not like that they can just scan any files on your harddrive. Their EULA appears to give them too much power. I did look at their privacy policy though and it appears they are not just scanning the drive.. maybe this should be added to the EULA.

Punkbuster's Privacy Policy

In short, Electronic Arts™ has offered to give this guy a new cd key since he has shown that he has a legit copy. This would right things in my mind, but the guy appears to have declined the offer of a new cd key and wants to spend his money defending what can only appear as a frivolous lawsuit. I hope he enjoys paying his lawyer and EB's attorney fees.

This is not EA's fault. He should cheat or give out his cd key. It could also be that someone generated the key with a keygen.. whatever the case EA has done the right thing by offering a new key. I would take the key and enjoy playing.

Really

I agree, with all your points. It is stupid to turn down a new key (Which solves the problem).

Though, it would also be smart to avoid punkbuster!

Sounds like he is going to be very broke, he was offered a solution.

Well I am not reading the 20 pages of people saying that he is a dumbass... Look at my comments. I posted exactly what was/is going on in there. The guy does not stand a chance...
